Welcome to Noctern ("we," "our," or "us"). By using our website, mobile apps, or services (collectively, the "Platform"), you agree to these Terms of Service. Please read them carefully.

1. Use of the Platform

  • You must be at least 18 years old (or the age of majority in your state) to purchase tickets or create events.
  • You agree to use the Platform only for lawful purposes and not to disrupt or harm the system or other users.
  • We may update, suspend, or discontinue parts of the Platform at any time.

2. Accounts

  • You are responsible for maintaining the confidentiality of your login information.
  • You must provide accurate, current information when creating an account.

3. Event Listings

  • Event organizers are solely responsible for the accuracy of event information, pricing, and any associated content.
  • Noctern does not guarantee the quality, safety, or legality of any event.

4. Payments and Fees

  • Ticket purchases may include service fees or taxes, which are disclosed at checkout.
  • Organizers agree to Noctern payout schedule and fee structure.

5. Cancellations and Refunds

All sales are final.

6. Intellectual Property

  • All Platform content, trademarks, and designs are owned by or licensed to Noctern.
  • You may not reproduce or distribute Platform content without written consent.

7. Limitation of Liability

  • Noctern is not responsible for damages, losses, or injuries arising from event attendance or use of the Platform.
  • Liability, if any, is limited to the amount you paid for the ticket.

8. Dispute Resolution

  • These Terms are governed by the laws of the State of Minnesota, USA.
  • Any disputes will be resolved in the courts of Ramsey County, Minnesota.

9. SMS Messaging Terms

Noctern Voice Ordering & Notifications

Program Description

By providing your phone number and opting in, you consent to receive SMS messages from Noctern related to:

  • Voice ordering verification codes for account authentication
  • Order confirmation links and ticket purchase details
  • Event reminders and updates for events you have purchased tickets to
  • Customer support communications initiated by you

Message Frequency

Message frequency varies based on your activity. Verification codes are sent only when you initiate a voice order. You may receive up to 5 messages per transaction. Recurring automated messages are not sent unless you opt in to event reminders.

Message and Data Rates

Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan. Noctern does not charge for SMS messages, but your carrier may.

Opt-Out Instructions

You can opt out of receiving SMS messages at any time by texting STOP to the number from which you received a message. After opting out, you will receive a single confirmation message and no further messages will be sent unless you re-subscribe.

Supported Carriers

SMS messaging is supported on all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages.

10. Prohibited Conduct

To keep Noctern safe and fair, you agree not to:

  • Post illegal, deceptive, or infringing content.
  • Harass users or interfere with platform operation.
  • Circumvent access controls, scrape without permission, or use bots to buy tickets.
  • Sell counterfeit tickets or misrepresent events.

Violation may result in suspension or termination of your account.

11. Cookies

We use cookies and similar technologies to operate our site, measure performance, and improve your experience.

  • Essential: Required for login, checkout, and core functionality.
  • Analytics: Helps us understand traffic and usage patterns to improve our service.
